It was a 16 year old kid who ran out in front of me. He's alright other than feeling pretty stupid for running out in front of a car... and lucky that I wasnt in my bigger car.

It was just before dawn yesterday and I was doing maybe 30. He had no visual injuries. After it happened I stopped to check on him and call 911. He was trying to stand, but I wouldnt let him. He was sitting upright talking to me before the ambulance got there. He was holding his right knee, so I'm pretty sure that was tweaked somehow.

Just curious, i've been explained in my criminal justice classes that even if the person admits to running out infront of you (and jay walking) and you hit them, no matter what it is your fault as the driver and can be held accountable. Except for ocean city, MD. go hit them all. kidding.

But did you get any charges on your part?

I was not issued any type of citation. My insurance company has filed it as a no fault/no claim accident. Sadly, I don't have collision coverage on the car so I'll have to fix it out of pocket.

One of the EMT's walked over to look at my car and I asked him if the kid was OK and all he said was "He's fine. He'll learn not to run out in front of cars."

There is an outside chance that his parents will pursue it for some sort of claim, but between what the cop and my insurance agent told me I'm not liable. I even asked if I should consult a lawyer, but they both said he has no case. Don't get me wrong... I feel completely terrible about it, and I'm not trying to put off responsibility, but I don't want to get taken advantage of either.

Oh, and I was able to pick up a pair of Mariner mirrors for $25... now to find the headlight. And I may just get some aftermarket smoked fogs instead of an OEM replacement.

so from what I'm reading the pedestrian is at fault correct?

isn't the pedestrian meant to pay for the damage?
